Nowadays, the development of information technology affects to the development of telecommunications so that it encourages the development of technologies related to mobile phone becomes very rapid. Ease of communication will impact to various modes of crime that exist in the realm of telecommunications crime in particular, and cybercrime in general. There is a lot of found several of scams cases via Short Message Service (SMS). It is very easy by using mobile phone to spread short message widely. However, it is not easy to find the perpetrator even though the mobile phone number has recognized by SMS sender. It does not guarantee that the registered number is the perpetrator’s name. Therefore, it needs further identification to make sure the real SMS spreader. In legal aspect, it is very important to find the perpetrator identity for law enforcement needs. By using biometric technology application, it expected to assist the real evidence in law enforcement on telecommunication crime. Therefore, this paper will use legal research with multidisciplinary method, such as legal comparative and technology approach to identify telecommunication crime via SMS scams and to examine consumer protection through biometric technology application.
