Indigenous child rights have been violated historically in both Australia and Canada. The cyclical process of discrimination and abuse within the policy framework of the modern states has resulted in familial dysfunction, high rates of suicides, and furthered dependence on state welfare. The paper seeks to look at the discourse on rights to understand the larger context underpinning the rising numbers of indigenous children in state sponsored non-indigenous foster care.
