This paper investigates the present law in England and Wales in relation to the land law right; known as rights to light. The present state of the law is analysed and is examined from two perspectives; that of the land owner and that of a developer wishing to develop land; that infringes the rights to light of the nearby land owner. The planning law process is examined and how it differs from the land law right. Is the present law clear and does it fairly balance the competing needs of these two parties; in a climate where economic regeneration is needed?
