This paper contains results of an investigation that took place in the fishing community of San Felipe, which is located in the nor-occidental coast of the high Gulf of Baja California. The purpose of the study was to characterize the riparian fishing community of shrimp in San Felipe, Baja California; in relation with its fishing practices and capacities, and opinion of the change in the NOM-002-SAG/PESC-2013.Taking in consideration that the achievement of the sustainable competitive advantage for the enterprises, it seems limited by the several factors such as: the sector were it is inserted, the politics and normativity, in between other factors; Latin-American investigations has found that the state role with its public politics it’s a key factor to improve the state capacities, that need to be work with , such issue is not always considered by the ones who make decisions about national or regional public politics. In Mexico, the situation is not so different, the riparian shrimp fishing in San Felipe, B. C. is an activity that has become a cultural slope in the matter of knowing about fishing, the ability and manners of fishing man that is teach from generation to generation, in addition, it’s an important activity from the economic and social point of view. Exploring the situation in which they unfold, this study was made, were it was found that the modification of the normativity that regulates this activity, the authorities that were involved has taken in consideration aspects of sustainability without taking in count the social, cultural and economic aspects of the community. This can cause giving negative results in the economic terms (no profitable activity) and propitiate the illegal fishing.
